Excluded Listings Regulation – Update

 

At the recent Board of Directors meeting on July 23, the Directors approved a change to the Excluded listings Regulation 9.8. This change clarifies that the only Exclusion form that BAREIS will accept is a BAREIS approved “Authorization to Exclude Listing from MLS” form.

9.8          Excluded Listings.  If the seller does not permit the listing or final reporting of sales data to be included in the MLS Database at the time the listing is taken, or at any time during the listing, the listing may not be entered into the MLS Database.  The listing broker must provide an BAREIS approved “Authorization to Exclude Listing from MLS” form to BAREIS within three Business Days of the effective date of the contract. (Effective 9/22/10)

The Authorization to Exclude form is used when excluding a listing from the MLS, the Internet, suppressing an address on the Internet, or for "Do Not Show" listings.

The Exclusion form was reworked last year, in part because the CAR exclusion (form SEL) addendum in WinForms®/zipForm® includes items that are not technically available in the BAREIS MLS® database. The CAR listing agreement allows for the use of the exclusion required by the local MLS.
